Brazil court orders Construtora Triunfo bankruptcy over unpaid ISS tax debt

The Justice of Paraná has declared the bankruptcy of Construtora Triunfo S/A, which had been under judicial recovery since 2019, due to a debt of R$ 40.8 million in Services Tax (ISS) that has been under collection since 2015. The ruling is being described as the first first-instance precedent on the issue, following recent changes in legislation and legal interpretation.

According to the decision, the tax debt was considered significant enough to justify the bankruptcy decree, even though the company had been trying to reorganize under court supervision for several years. Construtora Triunfo S/A has already filed an appeal against the ruling, seeking to reverse the bankruptcy order.

The case has drawn attention because it involves a tax-related debt in a judicial recovery proceeding and arrives after recent developments in both legislation and case law. As a result, the decision may be seen as an important reference for future disputes involving companies in recovery that face substantial tax obligations.

Constructora Triunfo S/A’s bankruptcy marks a major setback for the company, which had been attempting to preserve operations and restructure its finances since 2019. The ISS debt at the center of the case dates back to 2015 and had accumulated to R$ 40.8 million by the time of the ruling. The company’s appeal will determine whether the bankruptcy decree remains in force or is suspended while the matter is reviewed by a higher court.

The ruling from Paraná is notable not only for its direct impact on the company, but also for its potential legal significance. Because it is described as the first first-instance precedent on the matter, the decision may influence how similar cases are handled in the future, particularly where tax liabilities intersect with recovery proceedings and evolving legal standards.
